Terms and Conditions

Cancellations/Refundability
Payments for reservations are refundable as long as the cancellation is made by the customer via phone call or an email 24 hours prior to the trip’s arranged pick-up time and confirmed to be canceled with a representative. Reservations with special request fees may not be fully refundable due to the purchase of special request items and may be subject to those costs. Cancellations made within 24 hours of the reservation pick-up time will be subject to fees based on circumstances at cancellation, either a $50 fee or $75 fee that is assessed based on how late the cancellation is made. All ride share cancellations that are made within a 24-hour window will be subject to a $20 fee. Transportation services that have been performed for the client by prochauffeurlimo.com are nonrefundable after their completion and will only be provided under special circumstances. prochauffeurlimo.com reserves the right to process or refuse refunds in accordance with Standard Rental Agreement terms and company policies.

Reservations, Changes, & Overtime
The client understands that it is the client’s choice of time and vehicle arrangement for transportation and prochauffeurlimo.com will provide services to the client based on the client’s requests. prochauffeurlimo.com will provide the client with time/route/traffic estimates and recommendations based on the reservation, but it is ultimately the client’s decision to make arrangements for a transportation service. Due to this, prochauffeurlimo.com is not responsible for any consequences derived from the improper arrangement of a transportation service reservation such as, but not limited to, a late arrival, missed event, etc.

The client is responsible for following the reservation prearranged pick-up and drop-off time, and prochauffeurlimo.com will service the client based on these times but is not liable for lateness or consequences due to the client not being ready by the pre-arranged time. Furthermore, the client understands that transportation services may be affected by external forces such as but not limited to traffic, accidents, closures during the transportation service, and prochauffeurlimo.com is not responsible for such events. The client should be aware that these forces may affect the arrangement of the transportation service such as time usage, arrival, etc.

It is the client’s responsibility to notify prochauffeurlimo.com of reservation details such as addresses, times, special pick-up instructions or destination notes, airport flight information, etc., and prochauffeurlimo.com will follow the transportation itinerary based on the client’s instructions but is not responsible for consequences that arise from incorrect information provided to prochauffeurlimo.com such as wrong address, flight information, gate code, etc. The client understands that the amount paid is for the time period starting from pick-up and ending at drop-off, or in the case of a point-by-point ride/airport transportation a flat rate for 1 pick-up and 1 drop-off location. Any route, time, location, or itinerary changes made by the client may result in extra stops/waits/overtime/extended time of vehicle usage; it is the client’s responsibility to inform prochauffeurlimo.com of any changes and must confirm prochauffeurlimo.com’s acceptance prior to proceeding. The client understands and agrees that if the client decides to change the route, it is the client’s responsibility to pay for charges associated with these changes.

The client agrees to pay for charges made on the card on file/paying with the driver for the reservation due to any maintenance fees, overtime fees, and reservation fees. prochauffeurlimo.com allows a grace period of 15 minutes after the prearranged drop-off time as a courtesy to customers, in which the client will not be charged for that period. Overtime usage after this period will incur a fee of the vehicle’s reservation base hourly rate / $35 waiting fee. If the client exceeds more than 15 minutes after the prearranged drop-off time, the client will be charged with the price based on the vehicle’s hourly rate or waiting fee as purchased with reservation or as confirmed by a prochauffeurlimo.com representative. The client will be charged for the extended time either before, during, or at the end of the trip, which could be paid via card or cash. prochauffeurlimo.com does not guarantee that prochauffeurlimo.com can accommodate all of the client’s ride change requests or extended time requests due to possible other reservations; therefore, it is the client’s responsibility to notify prochauffeurlimo.com of possible overtime and get confirmation prior to the ride. The client understands that prochauffeurlimo.com will provide the client with the vehicle type that the client has requested to the best of prochauffeurlimo.com’s ability.

Any specific vehicle requests such as color, amenities, make, model, year, etc. will be subject to availability and maintenance of the vehicle. If the vehicle is unable to perform rides commercially due to mechanical reasons or others, then prochauffeurlimo.com will do its best to provide the client with an alternate vehicle similar to the vehicle that the client requested. Furthermore, if the client requests a change of vehicle from the original reserved vehicle, the client understands that this is subject to availability and to the discretion of prochauffeurlimo.com based on reservation schedule and change details. prochauffeurlimo.com works with prochauffeurlimo.com-approved affiliates to facilitate rides based on vehicle requests.

Force Majeure Events
prochauffeurlimo.com is NOT responsible for delay, change, termination, or alternative adjustments of a transportation service reservation due to any and all external forces, circumstances, or conditions which are outside of prochauffeurlimo.com’s control such as, but not limited to, manufacturer mechanic breakdowns, road/freeway/street/route closures, vehicle body conditions, extremely dangerous weather, collisions, unsafe road conditions, traffic, construction, accidents, etc. In the event of such, prochauffeurlimo.com will do its best to provide alternate transportation services for the client in the event of unforeseeable circumstances that arise which may interfere with the original arranged reservation but is not responsible for consequences of such events and changes. In the event that a transportation service cannot be performed at all due to external forces, prochauffeurlimo.com will do its best to notify the client.

Additional Service Fees
Depending on the type of vehicle and ride, there will be water and other complimentary drinks included such as 1 bottle of red wine/white wine/champagne/apple cider and sodas. Certain decorations such as balloons, napkins, sashes, are complimentary and provided by prochauffeurlimo.com as a courtesy for special events. Special decorations that are provided complimentary are a part of prochauffeurlimo.com’s service; color preferences or specific requests are not guaranteed as it is based on inventory and availability. If the client wishes to have additional special add-on requests, the client will be charged for the costs of such. Other additional services such as, but not limited to, tolls, parking fees, special decoration requests, surcharges, and optional in-car purchases are not included in the prices and will be charged either before or after the reservation. For airport reservations, luggage is included in the price and dependent on available capacity.

Airport Service
All airport drop-offs and pick-ups are curbside unless otherwise stated. There will be an additional $25 charge for Meet & Greet Services. The client must provide prochauffeurlimo.com with the following information for all airport rides: airline name/code, flight number, terminal number, amount of passengers, amount of luggage, and estimated arrival/departure times. prochauffeurlimo.com will check flight times prior to the reservation to confirm with the guest, but it is the client’s responsibility to notify prochauffeurlimo.com of any flight delays, cancellations, or no-shows. In accordance with airline provisions, it is recommended that guests arrive at the airport at least 2 hours prior to the flight boarding for domestic flights and 3 hours prior to boarding for international flights. It is not prochauffeurlimo.com’s responsibility to book and arrange a time for a guest’s flight; prochauffeurlimo.com will provide recommended times to prearrange an airport drop-off/pick-up following the airline guidelines and traffic patterns of the trip, but it is ultimately the client’s choice to decide what time they want to get picked-up or dropped-off.

For Airport Pick-Ups, the client should stand in a visible area where there is enough room for the vehicle to approach the curb and that the client can signal the driver to pull in. prochauffeurlimo.com’s Driver will be on time to the airport and ready to pick up the client after the client arrives from their flight, and the client must notify the driver that they are ready to get picked up after standing at the terminal and waiting to get picked up. The client understands that due to airport regulations on vehicles being parked curbside, the client may have to stand at the terminal arrival until the driver can legally and safely pull up to pick up guests. There is no loading in a lane of traffic, and the driver will have to circle if he/she is not able to pull to the curb if there is not space. No alcoholic beverages are provided for airport services.

Client Safety
The client understands that the client must follow all state, federal, and governmental laws and regulations while receiving transportation services from prochauffeurlimo.com. Such laws include but are not limited to, following the number of passengers allowed in the vehicle, using a child seat when required, seat belt usage, etc. All passengers traveling in the vehicle shall remain inside the passenger cabin at all times while the vehicle is in motion and shall not stand, move around, dance, and/or hang out of the sunroof or windows. If the client participates in any of these behaviors, the client is liable for any violations, fees, and consequences that result from their actions. The fine amount shall be determined by the authorities. prochauffeurlimo.com will not be responsible for injuries that may occur due to the client’s reckless behaviors while entering or exiting the vehicle, while the vehicle is in motion, or at a standstill.

The client is responsible for the behavior, actions, and damages caused by any guests or individuals the client permits to join in using the vehicle’s services. Features in the vehicle may include items such as, but not limited to, audio capabilities, lights, Bluetooth, Wi-Fi, TVs, smoke machines, disco lights, screens, etc., depending on the vehicle, and the client and passengers are accountable for using these functions safely and responsibly. The client has the choice and option to use or not use these features. prochauffeurlimo.com is not liable for consequences that result from the client’s use/misuse of these capabilities, which may result in harmful effects to passengers such as, but not limited to, playing extremely loud music that may affect ears, looking directly into lights that may affect eyesight, heavy use of smoke machines that may affect air quality, etc. In following regulations, prochauffeurlimo.com has provided fire extinguishers inside the passenger’s cabin of the limousines. Clients are not to use these fire extinguishers unless in the event of an emergency.

Clients are liable for any reckless usage, whether intentional or accidental, of these fire extinguishers and may have to pay fees or fines related to the misuse of these devices. Also in accordance with regulations, prochauffeurlimo.com has installed emergency ceiling exits in certain 9-passenger stretch limousines. Clients acknowledge that it is a violation to open this exit if the situation is not an emergency, and clients are not to attempt to open, play with, or alter this emergency exit in any way. Opening this exit while the limousine is moving is dangerous and may cause accidents and/or damage to others. Clients understand that passengers are liable for any damages that may occur from the improper use and handling of this emergency exit. prochauffeurlimo.com is not liable for consequences that may arise from the improper use, installation, or handling of the child seats. Clients who require a child seat must sign a waiver in order for prochauffeurlimo.com to provide it for the service.

Alcohol, Illegal Substances, Smoking
prochauffeurlimo.com will strictly enforce State and Federal Laws and will maintain a zero-tolerance compliance policy that no alcoholic beverages be consumed or used by any person under the legal drinking age. The client further understands and agrees that it is prochauffeurlimo.com’s policy and state law that no illegal drugs or contraband be used or in the possession of any passenger during transport. In the event the vehicle is seized or damaged due to the client’s illegal use or possession of alcohol, illegal drugs, or contraband, the client shall be held responsible for additional charges due to downtime in which the vehicle is unable to be hired out and for repairs to any damages and any fees that incurred due to this violation. If there are minors in the vehicle while there is alcohol present, the client must have a legal guardian present and sign a Leslie Bill agreeing that minors are not to come in any contact with liquor in the vehicle.

The client understands that it is prochauffeurlimo.com’s policy that NO smoking of any kind and substance takes place inside the vehicle, including but not limited to, cigarettes, cigars, e-cigarettes, vapes, marijuana, etc., whether legal or not. The client will be held responsible for any damages or cleaning costs necessary due to the violation of this policy up to $250.00 in maintenance and repairs. prochauffeurlimo.com drivers reserve the right to inspect the client’s belongings and inside the vehicle if suspected to have any illegal substances, unlawful alcohol, or illegal items. prochauffeurlimo.com drivers also reserve the right to terminate a ride if any alcohol or illegal substances are consumed by minors. prochauffeurlimo.com drivers also reserve the right to terminate a ride if the client’s and/or passengers’ misuse of alcohol consumption, reckless behaviors, smoking, or any type of harmful acts causes the vehicle, passengers, and driver to be in danger. In the event of termination due to the client’s or client’s guests’ misbehavior, the client will not be refunded for the reservation.

Vehicle Maintenance
All vehicles and items included in the vehicle are thoroughly cleaned and checked for damages prior to and after each engagement. The client shall be responsible for and assumes full financial liability for any damages, cleaning, or repairs which may be required due to any act of negligence or disregard by the customer or by the customer’s guests. Acts of such include, but are not limited to, breakage of any supplied items inside the vehicle or in the vehicle mechanical structure, interior, exterior, etc. A fee of $100.00 will be charged for each carpet or seat burn. A cleaning fee for any interior accidents such as, but not limited to vomiting, reckless behavior, spills, burns, cuts, tears, breakage, etc., caused by the client or client’s passengers is $250.00. Any exterior damages caused by the client or client’s passengers are subject to fees based on the extent of the damage.

Animals/Pet Policy
The client must inform prochauffeurlimo.com of any animals that will be on board the vehicle during transportation. prochauffeurlimo.com reserves the right to refuse service to any animals that are deemed as dangerous and unfit to carry in a motor vehicle. prochauffeurlimo.com allows pets (such as dogs or cats) to be inside the vehicle as long as the pet does not damage the interior of the vehicle. Any interior damages such as but not limited to, shedding, tears to leather seats due to claws or bites, urination, excrement, or solid matter discharge, will incur a cleaning fee, maintenance fee, or replacement fee of the damaged item up to $250.00. Pets can also be put inside a cage and placed in the vehicle, but the cage must be set on the floor of the vehicle and not on the seats. The driver will check the interior of the vehicle immediately after the ride and inform the client of any damages. It is recommended that the client bring items to contain pets such as leashes or mouth guards if applicable/necessary.

Dispute Resolution
Any dispute regarding the interpretation or implementation of this Agreement, including any claims for breach of this Agreement, shall be resolved by submitting the claim for binding arbitration to the American Arbitration Association in accordance with its rules and procedures applicable to commercial disputes. The location of any arbitration hearing shall be Orange County, California, and any enforcement of the arbitrator’s decision shall be brought in a Court of competent jurisdiction in Orange County, California.

Governing Law; Jurisdiction
This Agreement and all aspects of prochauffeurlimo.com Services shall be governed by and construed in accordance with the internal laws of the State of California, without regard to conflict of law provisions.

Indemnity
The client agrees to defend, indemnify, and hold prochauffeurlimo.com, its subsidiaries, and affiliates, and their respective officers, agents, partners, and employees, harmless from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to use of the prochauffeurlimo.com services, and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth above. Notwithstanding the foregoing, prochauffeurlimo.com reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify prochauffeurlimo.com, and you agree to cooperate, at your expense, with prochauffeurlimo.com’s defense of such claims. prochauffeurlimo.com will use reasonable efforts to notify you of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.

Miscellaneous
prochauffeurlimo.com is not responsible for any stolen, lost, damaged, misplaced, or leftover items in the vehicle from the trip. It is the client’s responsibility to care for all of the client’s and the client’s passengers’ own items and belongings by making sure that they are kept during and after the transportation. It is the client’s responsibility to notify prochauffeurlimo.com of any missing articles immediately after their ride and prochauffeurlimo.com will attempt to locate the item(s) by inspecting the vehicle, but does not guarantee retrieval. prochauffeurlimo.com will inspect the vehicle interior and exterior to our best ability and capacity and notify the client if any items are retrieved. prochauffeurlimo.com is not liable for and cannot provide reimbursements or replacements for any items that were lost, stolen, damaged, misplaced, or leftover from the ride.

If an item is found from the vehicle, it is the client’s responsibility to claim and retrieve the item. prochauffeurlimo.com will keep the item in prochauffeurlimo.com’s office as a courtesy to the client, and the client can choose to come get the item from the office or have prochauffeurlimo.com ship the item and pay a $30 handling fee as well as pay for the shipping costs. In case of an emergency situation, prochauffeurlimo.com is not responsible for the client’s health conditions and transportation to and from medical institutions. The client is welcome to beverages provided complimentary by prochauffeurlimo.com for the client, but the client cannot take prochauffeurlimo.com’s supplies provided for the ride such as, but not limited to, bottle openers, decorations, glasses, cups, cables, accessories, props, etc., unless it is a special request item that the client has paid for or has been confirmed by prochauffeurlimo.com to be provided complimentary and can be kept by the guest. If the client has a special request for a specified vehicle color make, year, amenities, features, etc., then prochauffeurlimo.com will do its best to accommodate this request, but does not guarantee availability for the specific request due to circumstances that are unforeseeable such as but not limited to maintenance repairs, unavailability, previously reserved bookings, etc. prochauffeurlimo.com works with prochauffeurlimo.com-approved affiliates to facilitate rides based on vehicle requests.
